Maryland men’s basketball’s Eric Ayala withdraws from NBA Draft, returns for senior season - Testudo Times

Maryland men’s basketball guard Eric Ayala has withdrawn from the 2021 NBA Draft and will officially return to college for his senior season, the program announced Wednesday.

Ayala was the top scorer last season for the Terps, averaging 15.1 points per game on nearly 44% shooting from the field. As a 2021 All-Big Ten selection, he also shot 33.7% from three and had a team-best 83.1% clip from the free throw line.

He has been a game-changing guard for Maryland, especially during this past campaign, as the Terps made it to the second round of the NCAA Tournament before being eliminated by Alabama.

“I’m excited to announce I’ll be returning to Maryland for my senior season,” Ayala said in a press release. “I took my time throughout this process and am appreciative of the feedback I received. I can’t wait to get to work with our team and play in front of the best fans in the country once again!”

Ayala’s return to College Park was critical for Maryland entering the 2021-22 season as many experts have the Terps projected as a top-15 team in Division I college basketball.

The Terps now await a potential announcement from Ayala’s teammate, Aaron Wiggins. If Wiggins were to return to college and forgo the 2021 NBA Draft, Maryland could be in store for a strong season after adding a few key transfers to round out the roster.

Arizona Republicans Strip Some Election Power From Democratic Secretary Of State - NPR

Arizona Republicans have stripped the secretary of state's office — currently held by a Democrat — of the right to defend the state's election laws in court, or choose not to, a change enacted as part of Arizona's newly signed budget.

The spending blueprint that Gov. Doug Ducey signed into law Wednesday declares that the attorney general — currently a position occupied by Republican Mark Brnovich — has sole authority over election-related litigation.

If the secretary of state and attorney general were to disagree over a legal strategy when Arizona election laws are challenged, the new law states that "the authority of the attorney general to defend the law is paramount."

Republicans also adopted language stating it's their intent for the law to apply through Jan. 2, 2023, coinciding with the end of Democrat Katie Hobbs' term as secretary of state.

Hobbs, the top election official in Arizona who's now running for governor, says her lawyers are looking at whether this change violates the Arizona Constitution.

"This is a petty, partisan power grab that is absolutely retaliation towards my office," Hobbs said. "It's clear by the fact that it ends when my term ends. ... It is at best legally questionable, but at worst, likely unconstitutional."

Republicans have generally cast the law as a cost-saving measure, citing Hobbs and Brnovich's frequent disagreements over how to defend state election laws that have been challenged in court. In 2020, Hobbs filed complaints with the state bar against Brnovich and other lawyers in his office.

Other election provisions in the budget

The budget includes a number of other election provisions, and it comes weeks after Republicans enacted new restrictions on early voting in the state, and as a controversial review of 2020 election results in Maricopa County continues.

Here are some of the other election-related measures in the budget:

  • New laws could soon require watermarks, QR codes and other security measures to be printed on ballots.
  • There's a new mandate to inspect state and county voter registration databases and create a report on voters who cast federal-only ballots — an option available to Arizonans who don't show proof of citizenship to register to vote in the state, but are still allowed to register under federal law.
  • And a new task force would investigate alleged social media bias as an unreported in-kind political contribution.

The ballot security measures, though not mandated by law in the budget, have the potential to be the most cumbersome and costly requirement for county election officials to implement.

The budget amendment provides a list of 10 "ballot fraud countermeasures" for counties to choose from — features like holographic foil, background designs similar to those found on banknotes and ultraviolet or infrared ink. If mandated, counties would have to implement any combination of at least three features from the list on their ballots. The budget provides $12 million to pay for those features, to be split among Arizona's 15 counties.

"By everyone's admission, there is only one company that can do any of this," said Jennifer Marson, executive director of the Arizona Association of Counties. "And so now, we can't have a competitive bid process or a traditional procurement process at the county or state level to use these countermeasures because we're locked into one company."

That company is Authentix, a Texas-based firm that provided Republican Rep. Mark Finchem with a sample ballot that included watermarks, QR codes and other security measures. Finchem had the sample ballot on display at the Capitol in March. According to the Yellow Sheet Report, it could be five times more expensive to print ballots with those security measures as it is to print paper ballots currently in use.

Marson said Finchem has acknowledged the security levels required of companies in the budget amendment could only be met by Authentix, and has vowed to mandate the ballot security measures in the "very near future."

Finchem defended the company in a brief email. He wrote that Authentix "offers these countermeasures to governments around the world for document and tax stamp security."

As the budget was being considered, Democrats like Sen. Tony Navarrete said the amendment is part of a broad effort to solidify conspiracy theories of election fraud.

"It's important for us to make sure we vote down conspiracy-laced amendments that are going to hurt the integrity of our election system in the state of Arizona and encourage other states to have these bad copycat laws spread like wildfire," he said.

Rubble from Surfside condo brought to grassy field in Miami-Dadefacebooktwitterinstagramrss - WPLG Local 10

MIAMI-DADE COUNTY, Fla. – Some of the debris from the collapsed Surfside condo is being brought to a warehouse so engineers can test the concrete and figure out why the building came crashing down.

But not all of it is useful.

That’s presumably why much of it is being dumped in a grassy field 10 miles away from the site of the Champlain Towers South.

Sky 10 video from Wednesday morning showed an excavator sitting on top of a huge pile of rubble near the intersection of I-95 and Florida’s Turnpike in Northwest Miami-Dade.

Dump trucks in groups of four, followed by a police escort, bring the debris to the grassy field near the Golden Glades Interchange.

The Florida Department of Transportation brought in extra personnel to handle the debris removal.

Four badly damaged cars are sitting a few yards away.

The pile is mostly concrete, cinderblocks and steel rebar. But it heartbreakingly also includes clothes and other personal belongings from the residents of the condo.

Police haven’t said why they’re bringing the debris here, but it’s possible it’s just to get it out of the way until it can be disposed of at a later time.

Police have also not disclosed the location of the warehouse where they’re storing the other concrete debris for analysis.

“There are detectives on the scene, engineers. They’re loading the trucks. It’s going to a ... secure site.” Miami-Dade County Police Director Freddy Ramirez said. “When it gets there it’s being cataloged and placed in certain areas.”

Jadon Sancho to join Manchester United from Borussia Dortmund for £72.9m - sources - ESPN

Manchester United have agreed a fee in principle with Borussia Dortmund for the transfer of Jadon Sancho, sources have told ESPN.

United are set to pay £72.9 million ($101m) for the England winger's move, according to sources. There are no add-ons as part of the deal.

Sources have also told ESPN that Sancho's former club and United rivals Manchester City will receive 15% of the profit made by Dortmund on the transfer, set to be around £9.7m.

Talks with Sancho's representatives, which began last summer, have gone smoothly and the 21-year-old will undergo a medical before signing a contract which will keep him at Old Trafford until at least 2026.

Sancho is currently on international duty with England at Euro 2020 and will continue to prepare for Saturday's quarterfinal against Ukraine in Rome.

United are not expected to officially announce the deal until after his involvement in the tournament is over. Among other things, there are quarantine issues surrounding him leaving the England training bubble then rejoining it, which he would need to do to have a medical and sign his contract.

But Sancho is expected to be part of Ole Gunnar Solskjaer's squad in time for the start of the Premier League season on Aug. 14.

It brings to an end a transfer saga that has gone on for nearly 18 months. Sancho was Solskjaer's top transfer target last summer, and although Sancho expressed his desire to move, United could not agree a fee with Borussia Dortmund.

Negotiations between the two clubs have progressed more quickly this time around.

Sancho has spent four years in Germany after arriving from Manchester City in 2017. He scored 50 goals in 137 games and was named in the Bundesliga team of the year in both 2019 and 2020. Despite coming through City's academy, he is yet to make a Premier League appearance.

We are saddened to share that The Appeal will be closing on June 30. However, we are excited to support the staff who are committed to relaunching The Appeal and carrying on our important work.

Please find two statements below. The first is from The Appeal’s executive director, advisory board, and fiscal sponsor. The second is from the Appeal transition team—the staff working to relaunch the media organization.

After more than three years of providing groundbreaking reporting and analysis aimed at solving the problems of discrimination, inequity and injustice in our society, we have decided to sunset The Appeal in its current form at the end of June. 

This was a difficult decision but one we believe is most consistent with our mission and values, responsibly manages our existing funding, and provides some level of stability for the people who have given so much to The Appeal.

As we have evaluated the challenging funding landscape, a fiscal restructuring, and changes in the project leadership, it became clear that The Appeal could not continue in its current form. This decision comes after extensive engagement with The Appeal Union, funders, and other stakeholders, and the consideration of various alternative pathways forward. 

Founded in 2018 as a mission-driven media organization covering the criminal legal system, The Appeal quickly grew into an influential outlet that produced rigorous reporting and analysis regularly cited by leading policymakers, journalists, scholars, and advocates. In addition to mass incarceration and policing, The Appeal’s coverage included housing and homelessness, economic stability, and other policies affecting our most vulnerable communities. We are extraordinarily proud of the work that The Appeal has produced and the impact it has had in the community. 

This is not the outcome we had planned or hoped for The Appeal. There has been an incredible amount of time, energy, talent, and resources devoted to this organization, and we are grateful to all who contributed to it. We are especially grateful to the remarkable people who have worked here and their deep commitment to The Appeal’s mission.

We support the staff who are committed to relaunching The Appeal and are hopeful about what’s to come. We are in ongoing discussions with them about their plans to carry on the work of The Appeal. Please see their statement to learn more about their next steps.

Statement From The Appeal Transition Team

Today we are officially announcing the worker-led effort to relaunch The Appeal. 

The executive director of The Appeal, The Appeal Advisory Board, and our fiscal sponsor, Tides Advocacy, have decided to shut down The Appeal in its current form on June 30, despite our union’s best efforts.

But we, the workers, are not giving up on the mission that has made The Appeal a leading national voice on the harms and injustice of the U.S. criminal legal system.

On the heels of our union wins and the public’s overwhelming support of that effort, a majority of us have formed a transition team that is taking steps to ensure that we can continue our vital journalism. 

For the time being, we will be working without pay to get this up and running. To support efforts to relaunch The Appeal, please make a monthly or one-time donation here. (Donations will be made to Scalawag, a 501(c)(3) nonprofit newsroom assisting the effort to relaunch.)

We are so proud of what we have accomplished so far. The Tiny Desk is working from home for the foreseeable future. Introducing NPR Music's Tiny Desk (home) concerts, bringing you performances from across the country and the world. It's the same spirit — stripped-down sets, an intimate setting — just a different space.


It's been said that our young people are the hope of our future. If that's true, the future of classical music looks blazingly bright, judging from these extraordinary performances by the young musicians in this triple-play Tiny Desk (home) concert.

Teenagers from three locales around the country – Chicago, St. Louis and Palo Alto, Calif. – invite us into their homes for fresh takes on vintage classics, contemporary sounds and sophisticated pop arrangements. They are all alums of From the Top, the radio program (distributed by NPR) that spotlights today's terrific young players.

Ifetayo Ali-Landing, an outstanding 18-year-old cellist from Chicago starts us off. She's already performed with the Chicago Symphony Orchestra and given her own TEDx talk. One of her calling cards is this propulsive performance of "Evergreen," a pop song by Yebba, arranged for solo cello.

Pairing up in Palo Alto, the Davisson Guitar Duo features Jack, 16, and his sister Elle, 13. Their signature piece is the rhythmically driven Jongo, which offers flavors from composer Paulo Bellinati's native Brazil. The siblings finish each other's musical phrases with startling lyrical precision.

Seventh-grader Jerry Chang, clad in his comfy exercise shorts, closes this cross-country Tiny Desk from home, playing Schubert's G-flat major Impromptu like someone twice his age. The gentle, rippling effects he gets from his still-growing 13-year-old hands, and the way he makes Schubert's wistful melody sing, is astonishing.

These Tiny Desk performances alone are proof enough that classical music in America is alive and in very talented hands.

4 more bodies found in Miami condo rubble; death toll up to 16 - NBC News

Four more bodies were recovered at the site of last week's partial collapse of a Miami Beach-area condo building, bringing the death toll to 16, officials said Wednesday.

Crews found the bodies in the rubble Tuesday night, Miami-Dade County Mayor Daniella Levine Cava told reporters during a morning news briefing. Relatives of the four victims have not been identified.

The number of unaccounted for people stands at 147, while 139 people who were in the building are accounted for, the mayor said.

Human remains were also recovered from the pile in addition to the four bodies recovered Tuesday night, Miami-Dade Assistant Fire Chief Raide Jadallah said, according to The Associated Press.

Meanwhile, Miami's top prosecutor said she will ask a grand jury to investigate the collapse.

"My office has a long tradition of presenting more than just criminal cases to the Grand Jury," Miami-Dade State Attorney Katherine Fernandez Rundle said Tuesday in a statement. "Our Grand Juries have also served as a cross-section of the community to evaluate matters of health and public safety," she said, adding that the grand jury issued a report in the aftermath of Hurricane Andrew in 1992.

"I plan to request that our Grand Jury look at what steps we can take to safeguard our residents without jeopardizing any scientific, public safety, or potential criminal investigations," she added.

It is not clear when Rundle plans to bring the matter before grand jurors.

She said she sent prosecutors as well as victim specialists to the site last Thursday morning, hours after nearly half of Champlain Towers South in the town of Surfside flattened.

President Joe Biden and first lady Jill Biden will visit Surfside on Thursday, the White House announced Tuesday.

More than 200 people are working on the mound of rubble in what authorities say is still a search and rescue operation.

"I have been overwhelmed by the heroics of the first responders who have labored tirelessly to save lives," Rundle, who has also visited the site multiple times, said.

She said engineers from the National Institute of Standards and Technology, which investigated in the aftermath of the Sept. 11, 2001, terrorist attacks, have told her that their investigation into the cause of the collapse would "take a long time."

"It is painstaking and complicated work," Rundle said. "I will not do anything to jeopardize their investigative findings. However, this is a matter of extreme public importance, and as the state attorney elected to keep this community safe, I will not wait."

Levine Cava told reporters Tuesday that she is "very supportive of the grand jury investigation" and "will do everything possible to aid them."

Investigators have not officially speculated what caused 55 of the 136 units in the northeast corridor of the 12-floor building to crumble about 1:30 a.m. Thursday.

But a trove of emails and documents released by the town of Surfside revealed that residents and contractors had been raising concerns about the integrity of the building for years.

A letter in April from Champlain Towers South Board President Jean Wodnicki to residents revealed the building's "concrete deterioration is accelerating.”

The letter, which explained why a renovation that had originally been estimated to cost about $9 million had jumped to $16 million in about three years, confirmed engineering consultant Frank Morabito’s 2018 prediction that already-extensive damage to the building "would begin to multiply exponentially."

Morabito recommended that concrete slabs, which were “showing distress” by the entrance and pool deck, “be removed and replaced in their entirety.” He said the concrete deterioration should "be repaired in a timely fashion."

A commercial pool contractor who was inspecting the pool last week told the Miami Herald that there “was standing water all over the parking garage,” and the biggest puddle of water was by parking spot 78, located under the pool deck, where Morabito had reported there was "major structural damage."

But in 2018, residents were not told of Morabito’s report, which was commissioned to get a start on a 40-year recertification process, as is required under the Miami-Dade County building code.

One resident told NBC News that a Surfside building official said at a meeting a month later "that the building was not in bad shape.” Meeting minutes released by Surfside confirm the resident's account, saying Surfside building official Rosendo Prieto told those present at the meeting that he had received and reviewed the structural engineer's report "and it appears the building is in very good shape."

Prieto also disregarded a Champlain Towers South board member’s 2019 concerns that nearby construction may cause damage to the building.

"We are concerned that the construction next to Surfside is too close," Mara Chouela wrote. "The terra project on Collins and 87 are digging too close to our property and we have concerns regarding the structure of our building."

Prieto responded, "There is nothing for me to check."

Prieto is on a leave of absence from his current job as a temporary building official for Doral, Florida, the city said. Prieto was an employee of C.A.P. Government, Inc. which was contracted by the city of Doral, according to a statement announcing his leave Monday.

Bill Cosby to be released after sexual assault conviction overturned by Pennsylvania Supreme Court - NBC News

Pennsylvania's Supreme Court vacated the sexual assault conviction of Bill Cosby on Wednesday and ordered his release from prison after finding that he was denied protection against self-incrimination.

The court said that a prosecutor's decision not to charge Cosby, 83, opened the door for him to speak freely in a lawsuit against him — and that testimony was key in his conviction years later by another prosecutor.

Cosby was convicted in 2018 of drugging and sexually assaulting a woman in 2004, and was serving a three- to 10-year sentence. He has served two years of the sentence.

The state Supreme Court said Cosby cannot be retried on the same charges.

"When an unconditional charging decision is made publicly and with the intent to induce action and reliance by the defendant, and when the defendant does so to his detriment (and in some instances upon the advice of counsel), denying the defendant the benefit of that decision is an affront to fundamental fairness, particularly when it results in a criminal prosecution that was foregone for more than a decade," the high court ruled.

"For these reasons, Cosby’s convictions and judgment of sentence are vacated, and he is discharged."

The prosecution of Cosby was one of the first major milestones of the #MeToo movement, as women came forward with their tales of unwanted sexual advances and harassment in the workplace.

Cosby’s spokesman Andrew Wyatt thanked the comedian's legal team and Pennsylvania Supreme Court, calling Wednesday's ruling a moment of justice for Black Americans.

"This is the justice Mr. Cosby has been fighting for," Wyatt said in a statement. "They saw the light. He waived his Fifth Amendment right and settled out of court. He was given a deal and he had immunity. He should have never been charged."

It wasn't immediately clear when exactly Cosby would be released from SCI Phoenix, where he's currently housed as inmate No. NN7687.

“The Pennsylvania Department of Corrections is in receipt of today’s court decision," a Department of Corrections representative said. "Work is underway to complete the necessary paperwork, and Mr. Cosby will be released as soon as practical.”

The entertainer once dubbed “America’s Dad” was sent to state prison following his 2018 conviction for drugging and sexually assaulting Andrea Constand.

She testified that Cosby assaulted her at his Pennsylvania home in 2004 after she came to him for career advice.

But Bruce Castor, the Montgomery district attorney at the time, declined to press criminal charges against the famed comedian and actor, "thereby allowing Cosby to be forced to testify in a subsequent civil action," according to the high court.

"Unable to invoke any right not to testify in the civil proceedings, Cosby relied upon the district attorney’s declination and proceeded to provide four sworn depositions. During those depositions, Cosby made several incriminating statements," according to the high court opinion.

"D.A. Castor’s successors did not feel bound by his decision, and decided to prosecute Cosby notwithstanding that prior undertaking. The fruits of Cosby’s reliance upon D.A. Castor’s decision — Cosby’s sworn inculpatory testimony — were then used by D.A. Castor’s successors against Cosby at Cosby’s criminal trial."

In a rare jailhouse interview in 2019, Cosby said he wouldn't offer any remorse for his actions — even if that would've impacted a parole board's decision.

"When I come up for parole, they're not going to hear me say that I have remorse. I was there. I don't care what group of people come along and talk about this when they weren't there. They don't know," Cosby told the news outlet BlackPressUSA.com.
